Abstract |
The article examines the concept and types of abuse of civil procedural rights, as well as the application of measures of responsibility for their commission, analyzes the legislative approaches to solving this problem of legal proceedings in the Code of Civil Procedure, Arbitration Procedure Code of the Russian Federation, Code of Administrative Procedure of the Russian Federation. It is noted that the problem of abuse of procedural rights is gaining relevance due to the increasing incidence of unfair behaviour of participants in civil proceedings. The article also examines the foreign experience of a number of countries in the application of measures of responsibility for abuse of procedural rights by participants in a trial. Based on the analysis of the legislation of the Russian Federation and law enforcement practice, a brief overview of existing measures of responsibility for abuse of procedural rights was made and proposals were made to improve them by making additions to the Code of Civil Procedure of the Russian Federation. |
